Wed Oct 14deadline to accept (not the decision date)
The Ombudsman does not print a decision date. The date above is the deadline the consumer was given to accept or reject the decision, which is set about a month after it was issued. It is reliable to the year, not to the month.
What this decision was about
Card dispute or chargeback, Service failure
In the Ombudsman’s words
The transaction was later reported by the card issuer as fraudulent and so Cardnet took the payment back from Mr B’s and Ms M’s business bank account.Card dispute or chargeback
I am satisfied that Cardnet was entitled to take back the fraudulent transaction. I can see that Mr B and Ms M then got that money refunded again through the direct debiting arrangements. So they now owe a debt to Cardnet, though this debt is not as large as it could be since Cardnet has refunded some charges on the account. Given my findings, I do not agree that Cardnet is obliged (either in law or as a matter of fairness) to write off the debt.Service failure

This page summarises the Ombudsman’s published final decision. The document itself is the record: DRN6310817.pdf on financial-ombudsman.org.uk.
The outcome shown is the Ombudsman’s own published classification, not our reading of the text. Nothing here is legal advice, and a decision concerns only the complaint it was made about.
