He considers in any event it should not have brought court proceedings against him and in doing so it breached both sections 77-79 of Consumer Credit Act 1974 and its obligations under sections 3 and 5 the Office of Fair Trading’s ‘s Debt Collection Guidance. He says it failed to respond to one of his letters as it promised to and provided poor customer service.
